End User License Agreement (EULA)

PLEASE READ THIS END USER LICENSE AGREEMENT (REFERRED AS "EULA") BETWEEN THE END USER (REFERRED AS “YOU”) AND THE COMPANY 4 WISE MONKEY (REFERRED TO AS “COMPANY”) CAREFULLY BEFORE INSTALLING, ACCESSING, OR USING ANY PRODUCT DEVELOPED AND GENERATED BY THE COMPANY (REFERRED AS "PRODUCT"). BY INSTALLING OR USING THE PRODUCT, YOU AGREE TO BE BOUND BY EULA AT ALL TIMES AND IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL, ACCESS, OR USE ANY OF THE PRODUCT GENERATED BY THE COMPANY.

  • License Grant
    4 Wise Monkey ("Company") grants you a limited, non-exclusive, non-transferable, revocable license to use the Product for personal, non-commercial purposes on a compatible device, subject to the terms of this Agreement.
  • Restrictions
    You agree not to:
    • Modify, reverse engineer, decompile, disassemble, or create derivative works based on the Product.
    • Use the Product for any unlawful or commercial purposes.
    • Rent, lease, sublicense, or distribute the Product.
    • Circumvent or attempt to circumvent any technical restrictions in the Product.
    • Use cheats, bots, hacks, or unauthorized third-party software to modify or interact with the Product.
  • Ownership
    All rights, title, and interest in the Product, including intellectual property rights, are owned by the Company or its licensors. This Agreement does not transfer any ownership rights to You.
  • User Content
    If the Product allows You to create, upload, or share content, you grant the Company a worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, and distribute your content for any purpose related to the Product.
  • Privacy
    Your use of the Product is subject to the Company’s Privacy Policy, which outlines how we collect, use, and share your information. By agreeing to this EULA, you also agree to the Privacy Policy and Terms of Services.
  • Updates and Changes
    The Company may update or modify the Product and also the policies, including its functionality, features, and design, at any time. These updates may be automatically installed without prior notice. Continued use of the Product after updates constitutes your acceptance of the updated Product. It is sole responsibility of You to recheck and stay updated on the changes.
  • Monetization
    The Product may include in-app purchases, advertisements, or subscriptions. By using these features, you agree to comply with their specific terms and conditions, including applicable payment terms and refund policies.
  • Refund Policy
    The Company does not process refunds directly. All refund requests must be handled through the respective app store where the purchase was made and should be requested within their refund policy threshold to the store directly.
    • Subscription Payments:
      • All subscription payments are non-refundable.
      • To avoid auto-renewal, you must cancel manually via your respective app store before the next billing cycle.
      • The Company is not responsible for cancellations or refunds for subscriptions.

    The Company does not guarantee immediate responses but will strive to address issues promptly.
  • Termination
    This Agreement is effective until terminated. The Company may terminate your access to the Product without notice if you violate this Agreement. Upon termination, you must delete all copies of the Product.
  • Disclaimer of Warranties
    The Product is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Limitation of Liability
    To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Product.
  • Limitation of Liability
    The Compnay does not guarantee uninterrupted or error-free operation of the Product.
  • Dispute Resolution
    • Governing Law: This Agreement is governed by the laws of Nepal.
    • Arbitration: Any disputes will be resolved through binding arbitration in Kathmandu, Nepal, under the Arbitration Act of Nepal (1999). Each party bears its own and all legal fees.
  • Consent to Data Collection
    By using the Product, you consent to the collection, storage, and processing of your data as described in the Privacy Policy. This includes data necessary for gameplay, analytics, and advertisements.
  • Parental Consent
    If you are under the age of 13, you must have parental consent to use the Product. The Company reserves the right to terminate accounts that fail to meet this requirement.
  • Severability
    If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Entire Agreement
    This Agreement constitutes the entire understanding between you and the Company regarding the Product and supersedes any prior agreements.
  • Acknowledgment and Acceptance
    By clicking “ACCEPT” or by installing or using the Product, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
